NRI Man Gives Triple Talaq To Wife Via Video Call Over Dowry Demand

During a video chat, a woman accused her husband and in-laws of harassing her over requests for money and the triple talaq divorce. A complaint has been filed under the Bharatiya Nyaya Sanhita (BNS) and the Muslim Women (Protection of Marriage Rights) Bill.

A guy who works in the United Kingdom (UK) and his parents are facing charges from Mumbai police for allegedly torturing his wife over dowry and using triple talaq to divorce her during a video conversation.

After reporting the incident to the NRI Sagar Police, the victim, a resident of Seawoods, was charged under various provisions of the Muslim Women (Protection of Marriage Rights) Bill and the Bharatiya Nyaya Sanhita (BNS).

The victim claims that her marriage to Aaqib Bhatiwala in 2022, which was performed in line with Muslim custom, appeared to begin amicably.

However, the abuse began when she moved into the Wadala home of her in-laws. According to reports, the assault continued in the UK, where she went with her husband and in-laws, where things reportedly became worse.

In a subsequent video call, she was granted a divorce by triple talaq. The victim says she was refused access to her husband’s house even after she returned to the UK.

Authorities have opened an investigation into the matter in response to her accusation. According to Islamic law, a husband can file for divorce from his wife by saying “Talaq” three times. This procedure is known as triple talaq.

A five-judge Supreme Court majority ruled in August 2017 that the practice of Triple Talaq, also known as Talaq-e-biddat, was “manifestly arbitrary” and illegal.

The Muslim Women (Protection of Rights on Marriage) Act, 2019 was passed by Parliament in 2019, making talaq-e-biddat a crime that carries a maximum sentence of three years in jail.
