The Supreme Court said on Tuesday, “Are you waiting for some muhurat?” as it blasted the Assam government for detaining foreign nationals in detention facilities for an extended period of time instead of deporting them.
The detained individuals should be deported right once if it is determined that they are foreign nationals, according to a bench of justices Abhay S. Oka and Ujjal Bhuyan.
“You have refused to start deportation saying their addresses are not known. Why should it be our concern? You are deported to their foreign country. Are you waiting for some muhurat (auspicious time)?
The next logical step must be taken after declaring someone to be a foreign national. You can’t hold them for all eternity. The Constitution has Article 21. Assam has a large number of detention facilities for foreigners. The bench asked the lawyer for the Assam government, “How many have you deported?”
The top court ordered the Assam government to produce a compliance affidavit and begin deporting the 63 people held in detention facilities within two weeks.
A case about the deportation of individuals who were deemed foreigners and facilities in Assamese detention centers was being heard by the bench.
